IRS Notice Of Deficiency

A notice of deficiency is a letter from the Internal Revenue Service (IRS) that advises a taxpayer that they have delinquent taxes owed plus any penalties and interest.

A notice of deficiency is also know as a 90-day letter because it gives the taxpayer 90 days to dispute the tax assessment. There are no extensions of time. If the taxpayer does not agree with the tax assessment, they can file an appeal with the U.S. Tax Court.

The first recommendation is not to panic. A taxpayer can resolve a dispute with the IRS without ever going to court by using the appeal process. The IRS for to Request for Appeals Review requires the taxpayer to list each item of the IRS decision that is in dispute with an explanation. Taxpayers can represent themselves during the appeals process or hire a Certified Public Accountant (CPA), attorney or Enrolled Agent (EA) to represent them. If the assessment is large, it is recommended to use a professional with experience with managing the appeal process and the IRS.
